As defendant one and two I accept this fact and expert witnesses testimony in its entirety.
• The witness confirmed that there is no evidence that tailings are re-suspending, but there is evidence that the tailings on the sea bed are stable and a thermocline layer in Buyat Bay exists starting at the bottom of the mixed layer at a depth of 40 to 50 meters
• Thermoclines would only keep the tailings from rising to the surface should the tailings be suspended in sea water and there is no evidence of this. Fundamentally, thermoclines do not keep tailings or sediments on the sea bed, gravity does.

As defendant one and two I accept this fact and expert witnesses testimony in there entirety.
• This witnesses testimony conveyed that in 2004 the Government of North Sulawesi formed a multi-discipline team to evaluate water and fish quality as well as the impact of tailings in Buyat Bay; the team concluded that levels of Mercury and Arsenic in sea water and fish are well below regulatory standards, there is no pollution in Buyat Bay.
• Extensive laboratory toxicology testing on tailings by this witness reviled similar result with that of the Governors Team in 1999 and reconfirmed that tailings from PT NMR’s operation are stable and did not fall into the classification of a B-3 waste.
• As a member of the KLH technical team, this witness further concluded that many institutions involved in the technical team report filed dissenting opinions as to the content of that report. At the same time this witnesses accepts the technical credibility of publicly released Ministry of Environment October 2004 Report.
• The witness also testified there is a strong indication that a witness from the prosecution, Masnellyarti Hilman, perjured herself before this court under sworn testimony
