  • 1. Accept the witness testimony that NMR complied and properly had evaluated the projected environmental impacts of the proposed mining project.
  • 2. That the government approved the companies AMDAL/RKL/RPL as tailing placement in sea was lower risks.
  • 3. Accept testimony that the government assess various issues and impact, including tailing and that tailings did not fit the criteria of hazardous waste or B-3.
  • 4. The department of Mines then issued a business license or operating permit which allowed the company to operate and discharge tailings into the sea.
  • 5. Accept testimony that the weight or s.g of tailing is sufficient enough to main the tailings on the sea bed as predicted in the AMDAL.

  • 1. Accept the witness testimony that PTNMR detoxified tailings before discharge as per design
  • 2. That the detoxification process changed arsenic in solution to ferro arsenate and mercury to cinnabar prior to discharge which are neutral & stable compounds.
  • 3. That PTNMR had an extensive monitoring program to ensure the detoxification process was working properly. Daily variability is normal and it was the monthly average was the target.
  • 4. That PTNMR measured both concentration (mg/l) and volume as part of its monitoring activities.
  • 5. That it is volume times concentration that is regulated and determines the load/discharge quantity to the environment.
  • 6. That the total amount of mercury and arsenics discharge was less then permitted.
